Notice and Take Down procedure (English version)

The Notice and Take Down procedure is intended for reporters who have a complaint about the content of a website hosted by Let’s Serve. If it is not possible to resolve the complaint directly with the holder of the website – for example because the holder does not respond, does not take action, or no contact information is available – the reporter can contact Let’s Serve via this procedure.
The procedure enables Let’s Serve to handle reports about illegal content with care. However, it is important to emphasize that Let’s Serve cannot take on the role of judge. Action is only taken in the event of undeniable unlawfulness, where the illegal nature of the content is immediately clear. Let’s Serve does not act on suspicions.
In order to process the report as efficiently as possible, the Notice-and-Take-Down form below (NTD form) must be completed completely and truthfully. In addition, it is required that the reporter has first approached the holder of the website himself to make the complaint known.
How does the Notice and Take Down procedure work?

Let’s Serve receives the notification via the NTD form below. If the form is not completed completely or correctly, the request cannot be processed and will be rejected. The reporter will receive a message by e-mail with the option to resubmit the request with additional or correct information.

Let’s Serve checks whether the website in question is hosted by us. If this is not the case, the request cannot be processed further and the reporter will receive a message about this by e-mail.

Let’s Serve shares the complaint with the customer and asks to respond within 2 working days. Please note: the identity of the reporter is hereby made known to the customer.
After 2 working days the following outcomes are possible:

The customer takes action:
The customer removes the material or places the website offline. This will successfully resolve the complaint. Both the reporter and the customer will receive confirmation by email.

The customer does not respond or refuses to take action:
a) Undeniable unlawfulness established:
Let’s Serve will assess the complaint within 2 working days. If there is undeniable unlawfulness, the website will be placed offline. Both the reporter and the customer will be informed of this by e-mail.
b) Undeniable illegality not established:
If Let’s Serve cannot determine that the content is undeniably unlawful, the Notice-and-Take-Down request will be rejected. The reporter and customer will receive a message about this by e-mail.
